Reproductive tourism to achieve pregnancy

Definition

Reproductive tourism, also known as fertility tourism, involves traveling to a foreign country with the goal of getting pregnant through fertility treatment.

This type of tourism is not only aimed at couples with problems to have a baby. The following are the family models to which fertility tourism adapts:

  • Heterosexual couples with male or female infertility
  • Lesbian couples
  • Single mothers
  • Gay couples
  • Single parents

The latter, gay couples and single men, can become a family thanks to the surrogacy.

Why does reproductive tourism appear?

The main cause of this displacement for reproductive purposes is the lack of regulation of these practices by the laws that exist in the country of origin, which prohibit some of the most important techniques or treatments that do not adapt to the family model.

For example, there are countries that prohibit the technique of preimplantation genetic diagnosis (PGD) or where egg donation is not allowed. This leaves many women in distress who do not get pregnant mainly due to health problems.

On the other hand is surrogate pregnancy, commonly known as a rental belly, which is illegal in many countries including Spain. However, in other countries like the USA. It is a regulated technique and used every day.

Treatments that are carried out abroad

There are some techniques in assisted reproduction that generate more controversy than others because of the ethics and religion of each country in general and of each person in particular.

The existence of legal obstacles does not facilitate the advancement of assisted reproduction in these countries either. Following are the practices most demanded in foreign countries:

Donation of semen and ovules

A large majority of patients who come to a fertility clinic need to resort to male or female donor gametes. The main reasons are the poor quality or absence of sperm and ovules, as well as single mothers who resort to artificial insemination with donor sperm.

There are two forms of donation: anonymous or known. In the anonymous donation the future parents can not know the person from whom the gametes are received, while in the other case, it is possible to choose the donor of semen or the donor of the ovules.

As for the legislation, you can find different situations:

  • Countries that directly prohibit the donation of gametes, such as Germany.
  • Countries with anonymous donation, such as Spain.
  • Countries with known donations, such as England.
  • Countries with known or anonymous donations, such as Denmark or the USA.

In terms of financial compensation, two situations can also be found: altruistic or commercial donation. The fact that there are countries with altruistic donations without any kind of compensation, like France, reduces the number of donors and, therefore, the waiting lists to receive the treatment are endless.

Preimplantation genetic diagnosis

Preimplantation genetic diagnosis is a technique for patients at risk of transmitting genetic diseases to their children, or who have alterations in the DNA of their gametes, which prevents pregnancy to end.

In some countries, such as Germany, it is forbidden to consider that the manipulation of the embryo is unethical, since PGD consists of extracting a cell from the developing embryo and analyzing it. It is the only way to make sure that this embryo does not have any genetic alteration.

In the case of Italy, the strong religious influence does not allow the destruction of embryos diagnosed as sick by PGD. Therefore, couples do not want to assume the maintenance cost of these embryos and look for other destinations to carry it out.

Sex selection

The choice of the sex of the baby by pure reproductive desire is not allowed in many countries, since it is necessary to make a DGP for it. This method is invasive and its use for non-therapeutic purposes is not contemplated.

Still, there are some couples who choose to resort to PGD and select the sex of the future baby. In most cases it is because they want a family with compensation of sexes or family balance, that is, when you already have a previous child and you want to have one of the opposite sex.

USA it is the country that receives the most visits for the selection of sex in a pregnancy. It is also allowed in Belgium and Mexico.

Baby sex selection

Subrogated pregnancy

Finally, surrogate pregnancy is the reproductive technique with the most conflict worldwide due to the ethical and moral problems it has. The fact of resorting to another woman to gestate and deliver the child to the parents of intention at birth has many detractors.

Today, to resort to surrogacy, it is necessary to travel to countries such as Canada, Greece, Ukraine, Russia and some US states. This is because they are countries that offer facilities to obtain legal paternity for the baby.

Reproductive tourism in Spain

The law of assisted reproduction in Spain is a pioneer by the multitude of techniques that are regulated in our country. Virtually all treatments in assisted reproduction are allowed, except for surrogate pregnancy and sex selection.

In Spain, the donation of gametes is anonymous and altruistic, although donors receive financial compensation for the inconvenience caused. Thanks to this there are many people willing to donate.

The fact that it is anonymous is also attractive for some patients, such as the British, who are afraid that their son may look for his biological father or mother in the future, since anonymity ceased to be a requirement on April 1, 2005 Currently, the British Act (HFEA Act) allows children born by gamete donation to consult, if they wish, the data of their donor when they turn 18 years old.

In addition, it is not surprising that the good climatic and gastronomic conditions of Spain help to choose our country to spend a few days of rest while carrying out a fertility treatment.

The Spanish Assisted Reproduction Law 14/2006 establishes in its article 10 the following:

The surrogate pregnancy contract between the pregnant woman and the parents of intention is null and the maternity will be awarded for the birth.
